“The non-use of a trademark or an article of merchandise
due to legal restrictions or circumstances beyond one's control
is not to be considered as an abandonment. Said rule was correctly
applied to the case at bar where the use of the trademark
was interrupted during the Japanese occupation and in fact
was discontinued when the importation of the product covered
by the trademark was prohibited by the Central Bank Regulations.”
